General conditions of sale
Article 1 SCOPE OF APPLICATION
1.1 The purpose of these general terms and conditions of sale is to govern the relationship between Martigny Brewing Co (WhiteFrontier and L'Echappée brands) and the Internet user, hereinafter referred to as the customer. The masculine form “customer” used hereinafter naturally refers to both customers and clients.
1.2 Sending an order to the customer implies acceptance of the present general terms and conditions of sale in their entirety, to the exclusion of any other terms or conditions. The customer declares that he/she has the capacity to contract with Martigny Brewing Co on the basis of the general sales conditions. The customer warrants that all information provided is accurate.
1.3 Registration at www.whitefrontier.ch, online shop, is reserved for persons with legal capacity. The data required for registration must be complete and truthful. Customers are responsible for updating their own data.
1.4 The sale of wine, beer and cider to persons under the age of 16 and the sale of spirits, aperitifs and alcopops to persons under the age of 18 is prohibited by law. By placing an order, customers declare that they are over 18 years of age. An identity check may be carried out upon delivery of the package.
Article 2 PRODUCTS
2.1 The products sold are described on the www.whitefrontier.ch website. The characteristics of the articles and the explanatory notes are given for information only and do not constitute contractual documents. The photos on the www.whitefrontier.ch site are for illustrative purposes only and do not form part of the contractual conditions. Martigny Brewing Co declines all responsibility for any errors or omissions related to the images or notices appearing on its online store.
2.2 The goods sold are of impeccable quality. The products are sold with no warranty other than that of the manufacturer.
Article 3 PRICES
3.1. The prices displayed on the www.whitefrontier.ch website include VAT at the rate in force at the time the order is placed. Prices are quoted in Swiss francs.
3.2 Martigny Brewing Co reserves the right to modify its prices at any time. However, the price invoiced for products delivered is that in force on the date of the order. This is shown on the order confirmation sent to the customer.
3.3. Promotional discounts offered as part of sales campaigns on the www.whitefrontier.ch website are deducted directly from the invoice amount. Promotional discounts and loyalty points or any other form of promotion are only valid as a reduction on future invoices. Loyalty points, promotional discounts and credit notes are valid for a maximum of twelve months after issue and expire without consideration or notice.
3.4. Offers on products are only valid as long as they are visible on the www.whitefrontier.ch website and within the limits of available stocks.
3.5 Martigny Brewing Co reserves the right to modify its prices and conditions at any time and without notice.
3.6. Martigny Brewing Co cannot be held responsible in the event of a computer bug unknowingly modifying the price of one or more items. Martigny Brewing Co thus reserves the right to cancel an order if the amount is not in line with the prices normally set for products and/or delivery costs.
Article 4 ORDER
4.1. The order becomes final upon acceptance by Martigny Brewing Co. The customer will receive an order confirmation by e-mail.
4.2 In the event of exceptional circumstances, notably insolvency or erroneous information, Martigny Brewing Co reserves the right to refuse a customer's order.
4.3 Martigny Brewing Co cannot be held responsible in the event of a computer bug unknowingly modifying the order. Martigny Brewing Co also reserves the right to cancel an order if the amount is not in line with the prices normally set for products and/or delivery costs.
4.4 Martigny Brewing Co reserves the right to cancel the order in the event that the products are out of stock. Martigny Brewing Co will, of course, refund 100% of the customer's order.
Article 5 PAYMENT
5.1. The customer can choose between payment by credit card (EuroCard/MasterCard or Visa), Paypal, Twint, Apple Pay, Google Pay. This method of payment is only available for orders placed from Switzerland.
5.2. For new customers or when the customer already has an open balance, Martigny Brewing Co reserves the right to request prepayment of the order.
Article 6 SECURE PAYMENT AND DATA PROTECTION
6.1. All payments are secure. Payment information is encrypted (https). Martigny Brewing Co has no access to this information.
6.2. Martigny Brewing Co's use of personal customer data complies with current legislation, in particular the Data Protection Act. Such data is treated confidentially and securely.
6.3. Martigny Brewing Co processes and stores only the data necessary for the proper performance and billing of its services. The personal data saved is used to facilitate the purchase of new articles by the customer and to guarantee the smooth running of the commercial transaction. Under no circumstances will this data be passed on to third parties.
6.4. Google Analytics: This website uses Google Analytics, a web analysis service provided by Google Inc (“Google”). This service uses cookies to help the website analyze how users use the site. You can disable the use of cookies by selecting the appropriate settings on your browser. However, such deactivation may prevent the use of certain features of this site.
Article 7 DELIVERY
7.1. Deliveries are only made within Switzerland and Liechtenstein. Products are sent to the delivery address indicated by the customer during the ordering process. By submitting the order, the customer acknowledges having read and accepted the general terms and conditions of sale.
7.2. For deliveries in Switzerland and Liechtenstein, products are delivered by Swiss Post or other carriers. As a general rule, items are available and delivered within 3 to 8 working days. If an item cannot be delivered, the customer will be informed by email.
7.3. In Switzerland, there are no deliveries on Sundays, national and cantonal public holidays.
7.4. The delivery times indicated by Martigny Brewing Co are provided for information only. Martigny Brewing Co makes every effort to meet them. However, failure to meet delivery dates may not result in cancellation of the order by the customer, nor justify a claim for compensation or a penalty for late delivery.
7.5. Martigny Brewing Co is not responsible for the theft of goods once they have been delivered by the Post Office. If there is any doubt as to the security of the letterbox, it is the customer's responsibility to request a signature. Upon delivery of the goods or their deposit in front of the customer's domicile, the benefits and risks (in particular of theft, deterioration by third parties, bad weather) are transferred to the customer.
7.6. Delivery notes and invoices are sent electronically whenever possible.
Article 8 PACKAGING
8.1. The customer is responsible for the disposal of returnable and non-returnable glass bottles, cans and packaging.
Article 9 DELIVERY COSTS
9.1. Packaging and shipping costs are at the customer's expense. They are indicated in the “basket” section of the order form and are calculated according to the weight of the parcel(s).
9.2. For Switzerland, shipping costs are calculated as a lump sum based on the delivery method chosen and the weight of the items purchased per order. Please refer to the “DELIVERY CONDITIONS” section for detailed information.
9.3. If products are not available at the time of delivery, they will not be sent at a later date, nor will they be replaced by other products. The quantity actually delivered is shown on the delivery note and the invoice. In the event of shortages or reduced quantities, the customer is not entitled to compensation or damages. If an invoiced item cannot be delivered, the corresponding amount will be refunded to the customer. There is no redelivery and the customer has no right to claim damages.
Article 10 OWNERSHIP
10.1. The goods remain the property of Martigny Brewing Co until payment of the invoice.
Article 11 RIGHT OF RETURN
11.1 It is the customer's responsibility to check the goods on delivery. In the unfortunate event of goods arriving at the customer's home in poor condition, Martigny Brewing Co will process the damaged goods within 48 hours, upon presentation of proof of the damage by photograph and explanation sent by email.
11.2 If the customer orders in error, the goods will not be returned or refunded.
Article 12 APPLICABLE LAW AND FORUM OF JURISDICTION
12.1 These general terms and conditions of sale and the contracts concluded in application thereof are governed by Swiss law.
12.2 In the event of a dispute, the place of jurisdiction is the legal domicile of Martigny Brewing Co, rue du Levant 99, 1920 Martigny.

Article 13 MODIFICATIONS TO GENERAL TERMS AND CONDITIONS
13.1. These terms and conditions may be modified at any time by Martigny Brewing Co.
13.2 It is the customer's responsibility to regularly inform himself/herself of the content and possible modifications of these general terms and conditions.
