General conditions of sale
Article 1 SCOPE OF
APPLICATION
1.1 The general conditions of sale are intended
to govern the relationship between the company WHITEFRONTIER LTD and the
Internet user, hereinafter referred to as the customer.
1.2 The dispatch of the order to the customer
implies the customer's acceptance of these general conditions of sale in their
entirety, to the exclusion of any other term or conditions. The customer
declares to have the capacity to enter into a contract with WHITEFRONTIER LTD
on the basis of the general conditions of sale. The customer guarantees that
all information provided is accurate.
1.3 Registration on the shop.whitefrontier.ch
website, online shop is reserved for people with the capacity to perform legal
acts. The data required for registration must be complete and truthful. Each
customer is responsible for updating their data themselves.
1.4 The sale of wine, beer and cider to persons under the age of 16 and the sale of spirits, aperitifs and alcopops to persons under the age of 18 is prohibited by law. By placing an order, customers declare that they are over 18 years of age. An identity check may be carried out upon delivery of the package.
Article 2 PRODUCTS
2.1 The products sold are described on the
shop.whitefrontier.ch website. The characteristics of the items and explanatory
notes are given for information only and do not constitute contractual
documents. The photographs appear on the shop.whitefrontier.ch website for
illustrative purposes and are not part of the contractual conditions.
WHITEFRONTIER LTD declines all responsibility for any errors or omissions
related to the images or notices appearing on its online shop.
2.2 The goods sold are of impeccable quality.
The products are marketed with no guarantee other than that of the
manufacturer.
Article 3 PRICES
3.1. The prices displayed on the
shop.whitefrontier.ch site include VAT at the rates in effect when the order is
placed. The prices are set in Swiss francs.
3.2. WHITEFRONTIER LTD reserves the right to
change its prices at any time. However, the price invoiced for the products
delivered is that in force on the date of the order. This appears on the order
confirmation sent to the customer.
3.3. Promotional discounts offered as part of
commercial actions on the shop.whitefrontier.ch site are deducted directly from
the amount of the invoice. Promotional discounts and loyalty points or any
other form of promotion is only valid as a reduction in future invoices.
Loyalty points, promotional discounts and credit notes are valid for a maximum
of twelve months after issue and expire without compensation and notice.
3.4. Product offers are only valid as long as
they are visible on the shop.whitefrontier.ch website and within the limits of
available stock.
3.5 WHITEFRONTIER LTD reserves the right to
modify its prices and conditions at any time and without notice.
3.6. WhiteFrontier LTD can in no way be held
responsible in the event of a computer bug modifying the price of one or more
items without its knowledge. WhiteFrontier LTD thus reserves the right to
cancel an order if the amount is not in accordance with the prices normally set
for the products and/or the delivery costs.
Article 4 ORDER
4.1. The order becomes irrevocable after its
acceptance by WHITEFRONTIER LTD. The customer receives an order confirmation by
e-mail.
4.2. In exceptional circumstances, including insolvency
or incorrect information, WHITEFRONTIER LTD reserves the right to refuse a
customer's order.
4.3 WhiteFrontier LTD can in no way be held
responsible in the event of a computer bug modifying the order without its
knowledge. WhiteFrontier LTD thus reserves the right to cancel an order if the
amount is not in accordance with the prices normally set for the products
and/or the delivery costs.
Article 5 PAYMENT
5.1. The customer has the choice between payment
by credit card (EuroCard/MasterCard or Visa), Paypal, Twint, Apple Pay, Google
Pay. This method of payment is only available for orders placed from Swiss
territory.
5.2. For new customers or when the customer
already has an outstanding balance, WHITEFRONTIER LTD reserves the right to
request prepayment of the order.
Article 6 SECURE PAYMENT AND DATA PROTECTION
6.1. All payments made are secure. The
information entered for the payment is encrypted (https). WHITEFRONTIER LTD has
no possibility of having access to it.
6.2. The use of personal data relating to the
customer by WHITEFRONTIER LTD complies with the legislation in force, in
particular the law on data protection. These are treated confidentially and
securely.
6.3. WHITEFRONTIER LTD processes and retains
only the data necessary for the proper performance of its services and the
invoicing thereof. The saved personal data facilitates the purchase of new
items by the customer and guarantees the smooth running of the commercial
transaction. Under no circumstances will this data be passed on to third
parties.
6.4. Google Analytics: This site uses Google
Analytics, a web analytics service provided by Google Inc. (“Google”). This
service uses cookies to help the website analyse its use by users. You can
disable the use of cookies by selecting the appropriate settings on your
browser. However, such deactivation could prevent the use of certain features
of this site.
Article 7 DELIVERY
7.1. Deliveries are made only on the territory
of Switzerland and Liechtenstein. The products are sent to the delivery address
indicated by the customer during the ordering process. Upon transmission of the
order, the customer acknowledges having read the general conditions of sale and
accepts them.
7.2. For deliveries in Switzerland and
Liechtenstein, the products are delivered by Swiss Post or other carriers.
Typically, items are available and delivered within 3-8 business days. If an
item cannot be delivered, the customer is informed by email.
7.3. In Switzerland, there is no delivery on
Sundays, national and cantonal holidays.
7.4. The delivery times indicated by
WHITEFRONTIER LTD are provided as an indication. WHITEFRONTIER LTD endeavours
to respect them. However, exceeding them cannot lead to the cancellation of the
order by the customer, nor justify a claim for compensation or a late payment
penalty.
7.5. WHITEFRONTIER LTD is not responsible for
the theft of the goods once deposited by the Post Office. If in doubt about the
security of the letterbox, it is the customer's responsibility to request
signed delivery. At the time of delivery of the goods or of their deposit in
front of the customer's domicile, the profits and risks (in particular of
theft, deterioration by third parties, bad weather) are transferred to the
customer.
7.6. Delivery notes and invoices are sent
electronically whenever possible.
Article 8 PACKAGING
8.1. The customer is responsible for the
disposal of glass bottles, whether returnable or not, boxes and packaging.
Article 9 DELIVERY COSTS
9.1. Packaging and delivery costs are the responsibility
of the customer. They are indicated in the "cart" section of the
order form and are calculated according to the weight of the package(s).
9.2. For Switzerland, shipping costs are
accounted for as a flat rate depending on the delivery method chosen and the
weight of the items purchased per order. We invite you to consult the
“CONDITIONS OF DELIVERY” section for detailed information.
9.3. If products are not available at the time
of delivery, they will not be sent later or replaced by others. The quantity
actually delivered appears on the delivery note as well as on the invoice. In
the event of missing items or reduced quantities, the customer cannot claim
either compensation or damages. If an invoiced item cannot be delivered, the
corresponding amount is refunded to the customer. There is no new delivery and
the customer cannot claim damages.
Article 10 PROPERTY
10.1. The goods remain the property of
WHITEFRONTIER LTD until payment of the invoice.
Article 11 RIGHT TO RETURN
11.1. It is the customer's responsibility to
check the goods upon delivery. If unfortunately the goods should arrive at the
customer’s domicile in poor condition, WHITEFRONTIER LTD will process the case
upon receiving photographic proof and explanations sent by email of the damaged
goods within 48 hours.
11.2 If the customer orders by mistake, the
goods will neither be taken back nor reimbursed.
Article 12 APPLICABLE LAW AND JURISDICTION
12.1 These general conditions of sale as well as
the contracts concluded in application are governed by Swiss law.
12.2 In the event of a dispute, the appropriate
jurisdiction is the legal forum of the company WHITEFRONTIER LTD, rue du Levant
99, 1920 Martigny.

Article 13 CHANGES TO THE GENERAL CONDITIONS
13.1. These Terms and Conditions may be amended
at any time by WHITEFRONTIER LTD.
13.2. Customers are responsible for regularly
informing themselves of the content and any changes to these general
conditions.
